Policy updates include adding a chart in the appendix that describes examples of evidence that may satisfy the O-1B evidentiary criteria, as well as considerations relevant to evaluating such evidence. The chart also assists petitioners in submitting appropriate evidence that may establish the beneficiary’s eligibility. The guidance also improves readability to help adjudicators with predictable and transparent application of the O-1B evidentiary requirements, in support of consistent decisions and improvements in efficiency. This guidance, contained in Volume 2 of the Policy Manual, is effective immediately. The guidance contained in the Policy Manual is controlling and supersedes any related prior guidance on the topic. We determined that universal biometrics collection is not necessary under INA 203(b)(5)(H)(iii) in connection with the filing of Form I-526E for all regional center investor petitioners in order to confirm compliance with INA 203(b)(5)(H)(i)-(ii).  However, we may request the submission of biometrics from a Form I-526E petitioner as may be necessary under INA 203(b)(5)(H)(iii), 8 CFR 103.2(b)(9), or under other applicable authorities. Since the form’s release in 2022, we have received about 980 Form I-526E petitions filed with the biometrics fee. We will refund these fees in the coming weeks. Petitioners do not need to contact USCIS to request a refund. We have released a revised edition of Form I-526E dated 03/15/23, with updated instructions. Effective May 15, USCIS will accept only the 03/15/23 edition of Form I-526E. Until then, you can submit either the new edition or the previous edition of Form I-526E (dated 06/01/22). The edition date is at the bottom of the page on the form and its accompanying instructions. Petitioners should be aware that the previous edition still contains instructions about the biometrics submission requirement that are no longer accurate. On July 12, 2022, we first published Form I-526E, Immigrant Petition by Regional Center Investor, as part of the EB-5 Reform and Integrity Act of 2022. An investor pooling their investment with one or more qualified immigrants participating in the Regional Center Program uses this form to petition USCIS for status as an immigrant to the United States under section 203(b)(5) of the Immigration and Nationality Act. USCIS continues to accept the latest paper version of this form by mail. “The availability of premium processing for certain F-1 students, in addition to the ease of online filing, will streamline the immigration experience for a great many international students,” said USCIS Director Ur M. Jaddou. “The ongoing expansion of online filing is a priority for USCIS as we continue to create operational efficiencies and increase access to the immigration system for stakeholders, applicants, petitioners, requestors, and those we serve.” Premium processing expansion for certain F-1 students will occur in phases, and students requesting premium processing should not file before these dates: Beginning March 6, USCIS will accept Form I-907 requests, filed either via paper form or online, for certain F-1 students who already have a pending Form I-765, Application for Employment Authorization, if they are filing under one of the following categories: (c)(3)(A) – Pre-Completion OPT; (c)(3)(B) – Post-Completion OPT; and (c)(3)(C) – 24-Month Extension of OPT for STEM students. Beginning April 3, USCIS will accept Form I-907 requests, filed either via paper form or online, for F-1 students in the above categories when filed together with Form I-765. USCIS will reject premium processing requests for a pending Form I-765 if received before March 6, and will reject any premium processing request for an initial or concurrently filed Form I-765 that is received before April 3. To file Form I-907 online, an applicant must first create a USCIS online account, which provides a convenient and secure method to submit forms, pay fees, and track the status of any pending USCIS immigration request throughout the adjudication process. There is no cost to set up a USCIS online account, which offers a variety of features, including the ability to communicate with USCIS through a secure inbox and respond to Requests for Evidence online. Applicants who previously filed a paper Form I-765 and wish to file Form I-907 online to request premium processing should reference the USCIS Account Access Notice they received for the Online Access Code and details on how to link their paper-filed cases to their online account, or they will not be able to file Form I-907 online and will need file a paper Form I-907 with the Chicago lockbox. As previously announced, the expansion of premium processing is part of USCIS’ efforts to increase efficiency and reduce burdens to the overall immigration system, and is being  implemented in a phased approach. This rule provides a framework for DHS to use its parole authority to grant a period of authorized stay, on a case-by-case basis, to noncitizen entrepreneurs who possess a substantial ownership interest in a start-up entity and who can demonstrate that their stay in the United States would provide a significant public benefit through that start-up entity’s potential for rapid business growth and job creation. After fully implementing the International Entrepreneur Rule in 2021, we have received a growing number of applications and continue to adjudicate them as expeditiously as possible. We are now publishing guidance in the Policy Manual, which includes information about: The criteria for consideration for the applicant, the start-up entity, and the qualified investment or government award or grant; Evidence and documentation; The discretionary nature of the entrepreneur parole adjudication; Conditions on parole and bases for termination; The criteria for consideration for an additional parole period; and Options available to the entrepreneur’s family to join the entrepreneur as parolees and, if eligible, to obtain employment authorization. Although an individual who is paroled into the United States has not been admitted into the United States for purposes of immigration law, parolees may enter and remain in the United States and may be authorized to work. This update is expected to help naturalization applicants who experience longer processing times, because they will receive an extension of lawful permanent resident (LPR) status and may not need to file Form I-90, Application to Replace Permanent Resident Card (Green Card). LPRs who properly file Form N-400, Application for Naturalization, may receive this extension without regard to whether they filed Form I-90. USCIS will update the language on Form N-400 receipt notices to extend Green Cards for up to 24 months for these applicants. The receipt notice can be presented with the expired Green Card as evidence of continued status as well as identity and employment authorization under List A of Employment Eligibility Verification (Form I-9), if presented before the expiration of the 24-month extension period provided in the notice. Prior to this change, under USCIS policy, naturalization applicants who did not apply for naturalization at least six months before their Green Card expiration date needed to file Form I-90, Application to Replace Permanent Resident Card (Green Card), to maintain proper documentation of their lawful status. Applicants who applied for naturalization at least six months prior to their Green Card expiration were eligible to receive an Alien Documentation, Identification, and Telecommunications (ADIT) stamp in their passport, which served as temporary evidence of their LPR status. This policy was based on the processing goal of 180 days or six months for Form N-400s, which would make filing Form I-90 unnecessary for applicants who filed at least six months before their Green Card expiration date. This policy update recognizes USCIS’ current processing times, while improving flexibility and efficiency by reducing the number of ADIT stamp appointments in field offices and the number of Form I-90s filed, which allows for these resources to be focused on other immigration benefit adjudications. The extension will apply to all applicants who file Form N-400 on or after Dec. 12, 2022. LPRs who filed for naturalization prior to Dec. 12 will not receive a Form N-400 receipt notice with the extension. If their Green Card expires, they generally must still file Form I-90 or receive an ADIT stamp in their passport, in order to maintain valid evidence of their lawful permanent resident status. Lawful permanent residents who lose their Green Card generally must still file Form I-90, even if they have applied for naturalization and received the automatic extension under this updated policy. This is because noncitizens must carry within their personal possession proof of registration, such as the Green Card and any evidence of extensions or may be subject to criminal prosecution under INA 264(e). Beginning Sept. 15, 2022, we will accept Form I-907 requests for: E13 multinational executive and manager petitions received on or before Jan. 1, 2022; and E21 NIW petitions received on or before Feb. 1, 2022. We will reject premium processing requests for these Form I–140 classifications if the receipt date is after these dates. We have 45 days to take an adjudicative action on cases that request premium processing for these newly included Form I–140 classifications. We will not accept new (initial) Forms I–140 with a premium processing request at this time. On May 24, 2022, we published a new version of Form I-907, dated 05/31/22. As of July 1, we no longer accept the older 09/30/20 edition of form I-907. As previously announced, we are expanding premium processing to additional form types as part of our efforts to increase efficiency and reduce burdens to the overall legal immigration system. As we implement the expansion of premium processing in a phased approach, we will continue working toward premium processing availability of additional Form I–140 petitions, Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization. We will also adhere to the legislative requirement that the expansion of premium processing must not cause an increase in processing times for regular immigration benefit requests.

Only individuals who are already residing in the United States as of October 20, 2022 will be eligible for TPS. “The United States recognizes the ongoing armed conflict and the extraordinary and temporary conditions engulfing Ethiopia, and DHS is committed to providing temporary protection to those in need,” said Secretary of Homeland Security Alejandro N. Mayorkas. “Ethiopian nationals currently residing in the U.S. who cannot safely return due to conflict-related violence and a humanitarian crisis involving severe food shortages, flooding, drought, and displacement, will be able to remain and work in the United States until conditions in their home country improve.” A country may be designated for TPS when conditions in the country fall into one or more of the three statutory bases for designation: ongoing armed conflict, environmental disaster, or extraordinary and temporary conditions. This designation is based on both ongoing armed conflict and extraordinary and temporary conditions in Ethiopia that prevent Ethiopian nationals, and those of no nationality who last habitually resided in Ethiopia, from returning to Ethiopia safely. Due to the armed conflict, civilians are at risk of conflict-related violence, including attacks, killings, rape, and other forms of gender-based violence; ethnicity-based detentions; and human rights violations and abuses. Extraordinary and temporary conditions that further prevent nationals from returning in safety include a humanitarian crisis involving severe food insecurity, flooding, drought, large-scale displacement, and the impact of disease outbreaks. This will be Ethiopia’s first designation for TPS. Individuals eligible for TPS under this designation must have continuously resided in the United States since October 20, 2022. Individuals who attempt to travel to the United States after October 20, 2022 will not be eligible for TPS under this designation. Ethiopia’s 18-month designation will go into effect on the publication date of the forthcoming Federal Register notice. The Federal Register notice will provide instructions for applying for TPS and an Employment Authorization Document (EAD). TPS applicants must meet all eligibility requirements and undergo security and background checks.
